Go Oil Warranty, Liability, and Website Terms and Conditions

Welcome to Go Oil’s Warranty and Terms and Conditions. Our mission is to provide transparent, high-quality mobile maintenance services while ensuring the protection of both Go Oil and our valued customers. Please read the following terms carefully, as they outline the scope of our service warranty, limitations, customer responsibilities, and website usage policies.
1. Service Warranty Coverage
Scope of Warranty:
- Parts and Labor: This limited warranty covers parts and labor directly associated with services performed by Go Oil employees, franchisees, or Go Oil-certified third-party providers.
- Warranty Period: The warranty is valid for the original customer only, commencing at the time of service and extending for 90 days or 3,000 miles, whichever occurs first, unless otherwise specified.
- Service Confirmation: Upon completion of services, customers will receive a detailed service report and may be required to sign a service acknowledgment confirming that all requested services have been performed satisfactorily.
2. Warranty Scope and Limitations
Covered Items:
- Service-Related Issues: Go Oil’s warranty covers defects in materials and workmanship related to the services performed.
Exclusions:
- Natural Wear and Tear: Go Oil is not liable for engine failure or mechanical issues arising from natural wear and tear, age, or pre-existing conditions unrelated to Go Oil’s service.
- Engine Condition Disclaimer: Our services involve oil and fluid changes and do not constitute comprehensive engine inspections. Go Oil is not responsible for engine failures or mechanical issues arising from pre-existing conditions, manufacturing defects, or unrelated component failures occurring after our service.
- Consequential Damages: Go Oil shall not be liable for any indirect, incidental, or consequential damages resulting from engine failure or mechanical issues, including loss of use, loss of income, towing expenses, or rental car fees.
- Post-Service Tampering and Unauthorized Handling: Go Oil is not responsible for damages resulting from unauthorized handling, tampering, or actions by third parties after the vehicle leaves Go Oil’s care.
- Negligence or Misuse: Warranty coverage is void if vehicle oil levels are not maintained, dashboard warnings are ignored, or the vehicle is operated under unsafe conditions.
- Unrelated Third-Party Actions: Any damages or wear resulting from unrelated third-party actions, vehicle abuse, accidents, or subsequent ownership will void this warranty.
- Third-Party Repairs and Modifications: Any repairs, modifications, or servicing performed by parties other than Go Oil, its franchisees, or authorized third-party providers will void the warranty.
- Unpaid Invoices: Any warranty claims are void if the customer's account has unpaid invoices for services rendered.
3. Property Damage Limitation
Property Damage:
- Limitation of Liability: Go Oil shall not be liable for incidental property damage, including but not limited to staining of driveways, parking areas, or other surfaces, unless such damage is a direct result of negligence by Go Oil personnel.
- Customer Advisory: Customers are advised to notify Go Oil of any special property considerations prior to service. Protective measures can be discussed to minimize the risk of property damage.
4. Wheel and Tire Services
Wheel Torque Responsibility:
- Proper Torque Procedures: For any services involving wheel removal and installation, Go Oil ensures that wheel lug nuts are torqued to manufacturer specifications at the time of service.
- Customer Responsibility: Customers are advised to have lug nut torque rechecked after 30 miles of driving. Go Oil is not liable for wheel detachment occurring after proper torque procedures have been followed and the vehicle has left our care.
- Service Documentation: Technicians will document torque specifications and may provide a torque check reminder to the customer.
5. Manufacturer Warranty Preservation
Compliance with Manufacturer Specifications:
- Quality Parts and Fluids: Go Oil uses oils and filters that meet or exceed manufacturer specifications to ensure compliance with vehicle warranties.
- Warranty Preservation: Our services are designed to maintain compliance with manufacturer warranties. Go Oil is not responsible for warranty claims denied by manufacturers unless it is proven that our service directly caused the issue.
- Customer Advisory: Customers are encouraged to consult their vehicle's warranty terms regarding maintenance requirements and to retain all service records.
6. Record Retention and Documentation
Record Keeping:
- Service Records: Go Oil maintains detailed service records for a minimum of ten (10) years.
- Accessibility: These records are available upon request to assist with warranty claims or service verifications.
- Photographic Evidence: Technicians may document services with time-stamped photographs as proof of service completion.
7. Customer Responsibilities
Vehicle Maintenance:
- Monitoring Vehicle Performance: Customers are responsible for monitoring their vehicle's performance and promptly addressing dashboard warnings or indicators.
- Fluid Levels: Maintaining proper fluid levels between services is the customer's responsibility.
- Post-Service Handling: Customers must ensure that no tampering or unauthorized repairs are performed on the vehicle after service by Go Oil.
- Torque Recheck: For wheel services, customers are responsible for rechecking lug nut torque after 30 miles of driving.
8. Franchisee and Third-Party Responsibility
Compliance with Standards:
- Service Standards: Franchisees and certified third-party providers must adhere to Go Oil’s approved service standards and procedures to ensure the validity of this warranty.
- Customer Service: Franchisees are required to handle customer inquiries, warranty claims, and follow-up services in alignment with Go Oil’s standards.
- Liability for Errors: Go Oil assumes no responsibility for damages resulting from franchisee or third-party errors that fall outside of Go Oil’s training, standards, and approved practices.
9. Warranty Claim Process
Initiating a Claim:
- Contact Information: Customers must contact Go Oil Customer Support or the original service provider within the warranty period.
- Required Documentation: Proof of the original service, such as a receipt or service order, is required.
Inspection and Verification:
- Vehicle Inspection: Go Oil reserves the right to inspect the vehicle to verify warranty claims.
- Additional Documentation: Additional documentation, including vehicle diagnostic data, may be requested to confirm the claim’s validity.
Approval of Claim:
- Valid Claims: If Go Oil determines the claim is valid, repair or replacement of the covered service will be completed at no additional cost to the customer.
- Invalid Claims: If the claim is denied, Go Oil will provide an explanation outlining the reasons for denial.
10. Limitation of Liability
Liability Cap:
- Maximum Liability: Go Oil's total liability under this warranty shall not exceed the total amount paid by the customer for the specific service from which the claim arises.
No Consequential Damages:
- Exclusion of Damages: Go Oil is not responsible for any indirect, incidental, or consequential damages, including but not limited to vehicle downtime, towing fees, rental expenses, loss of income, or any other financial losses.
11. Indemnification
Customer Indemnification:
- Hold Harmless Agreement: Customers agree to indemnify and hold harmless Go Oil, its officers, employees, agents, franchisees, and affiliates from any claims, damages, or expenses arising out of the customer's breach of these terms or misuse of services.
12. Dispute Resolution and Arbitration
Binding Arbitration:
- For Services Performed in Canada:
Any disputes, controversies, or claims arising out of or relating to these terms and conditions, or the breach thereof, shall be resolved through binding arbitration administered by the ADR Institute of Canada in accordance with its Arbitration Rules. The place of arbitration shall be Winnipeg, Manitoba, Canada. - For Services Performed in the United States:
Any disputes, controversies, or claims arising out of or relating to these terms and conditions, or the breach thereof, shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The place of arbitration shall be Fargo, North Dakota, United States.
Arbitration Procedures:
- The arbitration shall be conducted by a single arbitrator appointed in accordance with the applicable rules.
- The language of the arbitration shall be English.
- The arbitrator shall have the authority to award any remedy or relief that a court of competent jurisdiction could grant, in accordance with these terms and conditions.
- The arbitrator's award shall be final and binding on the parties, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
Exception:
This arbitration agreement does not limit either party's right to seek temporary or preliminary injunctive relief or other equitable remedies in a court of competent jurisdiction, pending the arbitrator's final decision.
Class Action Waiver:
All claims and disputes within the scope of this arbitration agreement must be arbitrated on an individual basis and not on a class basis. The parties expressly waive any right to pursue any class or collective action or to have any claim heard in a representative capacity on behalf of others.
Confidentiality:
The parties agree to keep the arbitration proceedings and any related documents confidential, except as necessary to enforce any arbitration award or as required by law.
13. Governing Law and Jurisdiction
Applicable Law:
- For Services Performed in Canada:
These terms and conditions shall be governed by and construed in accordance with the laws of the Province of Manitoba, Canada, without regard to its conflict of law provisions. - For Services Performed in the United States:
These terms and conditions shall be governed by and construed in accordance with the laws of the State of North Dakota, United States, without regard to its conflict of law provisions.
Jurisdiction and Venue:
- For Services Performed in Canada:
Any legal actions or proceedings arising out of or relating to these terms and conditions shall be brought exclusively in the courts located in Winnipeg, Manitoba, Canada. - For Services Performed in the United States:
Any legal actions or proceedings arising out of or relating to these terms and conditions shall be brought exclusively in the courts located in Fargo, North Dakota, United States.
14. Website Use Terms and Liability Disclaimer
Acceptance of Terms:
- User Agreement: By accessing and using the Go Oil website, customers acknowledge that they have read, understood, and agree to be bound by these terms and conditions.
